Bel Viso Body Bar Pty Ltd Standard Warranty
DEFINITIONS and INTERPRETATIONS
“Machine” means:
EMS Electro Muscles Stimulators; Diathermy Heat Body Wraps; Micro-current Non-surgical Facelift; Nue-Skin Microdermabrasions; “G5® Massage Therapy Systems”.
The Singular includes the plural and vice versa.
1. GENERAL TERMS and CONDITIONS
1.1. The “Machine” has been manufactured to the highest quality standards and is warranted to the original purchaser only. This warranty is not transferable unless otherwise specified by Bel Viso Body Bar Pty Ltd.
1.2. The “Machine” is guaranteed to be free from defects in workmanship and parts (accessories and/or attachments are NOT included) for a period of 3 YEARS (except where otherwise stated) from the date of purchase. Defects that occur within this warranty period, under normal use and care will be repaired or replaced at our discretion, solely at our option with no charge for parts or labour.
1.3. Bel Viso Body Bar Pty Ltd reserves the right to replace the “Machine” or relevant part with the same or equivalent “Machine” or part, rather than repair it. Where a replacement is provided the “Machine” or part replaced becomes the property of Bel Viso Body Bar Pty Ltd. Bel Viso Body Bar Pty Ltd may replace parts with refurbished parts. Replacement of the “Machine” or a part does not extend or restart the warranty period.
1.4. The benefits conferred by this warranty are in addition to all rights and remedies in respect of the “Machine” that the consumer has under the Trade Practices Act and similar state and territory laws.
1.5. Under normal warranty conditions the “Machine” must be returned to the specific address Bel Viso Body Bar Pty Ltd gives to the Purchaser, at the Purchaser‘s expense.
1.6. Please ensure that the product is properly packaged so as to ensure that no damage occurs to the “Machine” during transit.
1.7. In the event that the “Machine” requires repair under warranty, the Purchaser is responsible for the cost of transportation to and from the service centre. Whilst in transit the “Machine” is at the Purchaser‘s risk.
1.8. Should the “Machine” be found in sound working order the Purchaser might be charged a fee.
1.9. Please keep your purchase invoice/receipt as proof of purchase and as proof of the date on which the purchase was made. The purchase invoice/receipt must be presented with the warranty when making a claim under this warranty. If in the event the invoice/receipt of purchase is not presented, then this warranty is invalid.
2. GENERAL EXCLUSIONS and LIMITATIONS
2.1. In the event that no identical “Machine” is available for service repair, Bel Viso Body Bar Pty Ltd has the right to replace the “Machine” with a device of equal capacity, or offer the customer the choice of a “Machine” upgrade, which may incur an extra cost.
2.2. This warranty is limited to defects in workmanship or parts only. All defective “Machine” or parts will be repaired or replaced. This warranty does not extend to accessories and/or attachments. This warranty does not cover tutorial DVDs, manuals & packaging, line cords, leads & pads or wiring or any other consumable item.
2.3. This warranty does not cover any defect caused by an accident, misuse, abuse, improper installation or operation, lack of reasonable care, unauthorised modification, loss of parts, tampering or attempted repair by a person not authorised by Bel Viso Body Bar Pty Ltd.
2.4. The warranty will not apply if the factory-applied serial number and/or warranty seal has been altered or removed from the “Machine”.
2.5. The warranty will not apply if damage, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, liquid spillage, mis-adjustment of customer controls, use on an incorrect voltage, power surges and dips, thunderstorm activity, acts of God, voltage supply problems, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, exposure to abnormally corrosive conditions or entry by any insect, vermin or foreign object in the “Machine”.
2.6. This warranty does not cover damage arising during transportation, installation or while moving the “Machine”, or to any transportation costs of the “Machine” or any parts thereof to and from the Purchaser, unless otherwise specified in these warranty conditions.
2.7. Bel Viso Body Bar Pty Ltd will not be liable for any loss, damage or alterations to third party furniture, hardware or software no matter how occurring or for any loss or damage arising from loss of use, loss of profits or revenue, or for any resulting indirect or consequential loss or damage.
2.8. Bel Viso Body Bar Pty Ltd’s aggregate liability in respect of all claims under the warranty shall not exceed the original purchase price of the “Machine” or, at Bel Viso Body Bar Pty Ltd’s option, the cost of replacing the “Machine”.
2.9. Bel Viso Body Bar Pty Ltd excludes all other warranties, conditions, terms, representations and undertakings, whether express or implied.
